No More Disunity In Europe

TLIP has often raised concern about this rule to the EPO because it increases costs to applicants and leads to a lack of informed choice as to which invention to pursue.
Pleasingly for applicants Rule 164 EPC will be amended from 1 November 2014.
Rule 164 EPC will change to allow applicants to request an additional search where the European patent searching division find a lack unity of invention in the claims. A two month term will be given to make the request and the results will mean the applicant can choose which subject matter to pursue as the main invention with the knowledge of the prior art.
